The following Terms and Conditions apply to all purchases of products by you from kotee.shop. Please read them carefully. We may vary these terms from time to time and therefore you should check to ensure you have the latest version before you make a new purchase.
By using kotee.shop you confirm to have read and accepted these Terms and Conditions. Reading and accepting Rules and Regulations is considered as providing an information by Contractor to the Customer, which is mentioned in article 12 of Consumer Protection Act form 30th of May 2014 (Dz. U. from 2014 pos. 827), information required is included below.
1.1 Kotee.shop (this site) is owned and operated by Bartosz Kaluzny, Registered number 251451426, Registered in Poland, Registered Office: Korczaka 6.1, 63-700 Krotoszyn, Poland, VAT Number: PL 6211486480. You can contact us by sending email to: customer@kotee.shop, writing to: Kotee Customer Support, Korczka 6.1, 63-700 Krotoszyn, Poland, or calling us on +48 573 25 30 35. 
1.2. Customer - a natural person, with full legal capacity or legal person (corporation), which is placing or willing to place an order in the Internet Store, herein referred as ”Customer".
1.3 Order – statement of will leading to conclusion of Distant Sale Agreement specifying type and number of Goods, final price and delivery costs of Goods ordered.
1.4 Goods - products presented in kotee.shop which are subject of Sale Agreement
1.5 Sale Agreement - legal agreement of sale of products as defined in the Civil Code and Consumer Protection Act, transacted from a distance between the kotee.shop and the Customer, using distant means of communication.
1.6 Terms and Conditions - this document
1.7 Civil code – legal act from 23rd of April 1964 (Dz. U. 1964 No. 16, pos. 93, as amended).
1.8 Consumer Protection Act - legal act form 30th of May 2014 (Dz. U. 2014 pos. 827).
1.9 Act on Rendering Electronic Services – the Act on Rendering Electronic Services dated 18 July 2002 (Journal of Laws No. 144, Item 1204, as amended);


2.1. The kotee.shop may be accessed if the IT equipment used by the Customer meets the following minimum technical requirements:
2.1.1 a computer or a mobile device with access to the Internet,
2.1.2 access to electronic mail,
2.1.3 a browser Internet Explorer – version 11 or newer, Firefox – version 28.0 or newer, Chrome – version 32 or newer, Opera – version 12.17 or newer, Safari – version 1.1. or newer,
2.1.4 enabling cookies and JavaScript in the web browser.
2.2. Using the kotee.shop shall mean every activity of the Customer which familiarises him with the Shop content. 2.3. The Customer shall be obliged in particular:
2.3.1 not to provide and not to transfer any content forbidden by provisions of law, e.g. the content which is defamatory, promotes violence or infringes personal rights and other rights of third parties,
2.3.2 to use the Online Shop in the manner not interfering with its functioning, in particular by using specific software or devices,
2.3.3 not to perform any actions such as: sending unsolicited commercial information (spam) or placing it within the Online Shop,
2.3.4 to use the Online Shop so as not to disturb other Customers and the Seller,
2.3.5 to use all the content within the Online Shop solely for one’s own personal purposes,
2.3.6 to use the Online Shop in accordance with the provisions of law applicable in the territory of the Republic of Poland, with the Terms and Conditions, as well as with general principles of using the Internet.


3.1 Information about the Goods as provided on the kotee.shop websites, in particular their descriptions, technical and functional parameters as well as prices constitute an invitation to conclusion of an Sale Agreement within the meaning of Article 71 of the Civil Code.
3.2  Orders can be placed only by the kotee.shop Customer, who have correctly filled in Registration Form.
3.2.1 Registration Form requires providing following data: name, surname, shipping address, e-mail address, contact phone number. In case of insufficient information provided, kotee.shop reserves the right to refuse completion of an order. A lack of due diligence while filling in the form may cause the Customer being obligated to cover additional expenses such as: compensation, costs of improper postage, costs of resending the order to the right address, or any other rightful costs incurred by the kotee.shop to complete the Order.
3.3 Order can be placed 24 hours a day, 7 days a week. Goods marked as ‘Handcrafted’ or ‘Made to order’ are usually manufactured within 5 (five) business days, after receiving payment.
3.4 Each order precessing starts after a payment has been confirmed. See more in Payment Section of this document.
3.5 When the Order is placed on the kotee.shop website, the Customer places the Order with the Seller electronically, which constitutes an offer to conclude the Sale Agreement of the Goods being the subject of the Order. The offer made electronically shall be binding for the Customer if the Seller sends – to the electronic mail address provided by the Customer – a confirmation of acceptance of the Order for processing, in the form of the Seller’s declaration of acceptance of the Customer’s offer; upon its receipt by the Customer the Sales Agreement shall be concluded.
3.6 In case of any circumstances making placed order impossible to complete, kotee.shop reserves the right to suspend the order, and will immediately notify the Customer about the situation.
3.7 All prices (in GBP and EUR) are inclusive of VAT, but exclude shipping costs. For more information, please refer to Shipping Section of this document. 3.8 kotee.shop will start processing the Order once the price is paid in full, and the funds are confirmed.
3.8. In case of price change, order will be completed with the price valid at the moment of purchase (Contract of Sale).
3.9. The invoice will be sent to a Customer by e-mail.
3.10. kotee.shop reserves a right to: change the prices of the products, to introduce new products, to delete products from an offer, to perform, stop or modify discounts and sales.
3.11. Order will be completed if item is available.
3.12. Discounts or sales do not combine, as long as additional rules do not state so.


4.1 Customer may choose the following payment methods:
4.1.1 bank transfer to the Seller’s bank account 
4.1.2 electronic payment (card payment, paypal)
4.2 In each case, precessing of the order immediately upon receiving funds to either Seller’s bank account or confirmation from the electronic payment processor.
4.3 Electronic payments for kotee.shop are processed by Dotpay Settlement Centre. Transactions processed by Dotpay Settlement Centre ensure the highest level of security. More information can be found at www.dotpay.pl
4.4 Bank Transfer can be made to the following accounts:

4.4.3 Account holder: Bartosz Kaluzny, Korczaka 6.1, 63-700 Krotoszyn, Poland. Please always quote the order number.
4.5 Bank transfer payment should be done immediately after placing the Order, so that the amount due cleared in kotee.shop’s account within a maximum of 7 days  from a day of placing the Order. Otherwise, the order is considered ineffective.


5.1 Shipping for kotee.shop is carried out by DPD and UPS. Shipping price is depended on the weight of Goods ordered and specified during order placement, before order confirmation.
5.2 Shipping costs are covered by the Customer.
5.3 All items marked 'In stock' are posted within 1 working day, items marked as 'Handcrafted to order', are posted within 5 working days.
5.4 Before collecting the parcel, Customer is obliged to verify the content of the package in the presence of the delivery person If the package was damaged during the transportation process a protocol of complaint shall be prepared and signed by both the Customer and the delivery person. Checking the package is an essential condition of taking into account any Customers` claims of package being damaged in the transport. Courier company is obliged to deliver the goods undamaged and is liable for customer complaints concerning damage in transport.
5.5 The ability to complain on account of the unsatisfactory performance of the postal/courier service expires at the moment of accepting the package without any objections, unless the damage was unnoticeable from the outside. If the damage was recognised within 7 days upon receiving the package and it is clear that the package was damaged before the receipt, courier company is still liable for customer complaint about the damage. In such case kotee.shop should be informed about it.
5.6 If a Customer will not pick up purchased Product, he/she is responsible to cover any expense of sending it back to kotee.shop.


6.1. The right to withdraw from the Agreement
6.1.1 The Customer who is a Consumer may withdraw from the Agreement without specifying the reason by submitting an appropriate declaration within 14 days. To keep this deadline it is enough to send this declaration before its lapse.
6.1.2 The Customer may compose the declaration by himself or use the form of declaration of withdrawal from Agreement, which constitutes Appendix No. 1 to the Terms and Conditions.
6.1.3 The 14-days’ deadline shall be calculated from the day when the Goods were delivered or – in the case of an Agreement for Services – from the day it was concluded.
6.1.4 Upon receipt of the Consumer’s declaration of withdrawal from the Agreement, the Seller shall send a confirmation of receipt of the declaration of withdrawal from Agreement to the Consumer’s electronic mail address.
6.1.5 The right to withdraw from Agreement by the Consumer shall be excluded in the following cases: for rendering services, if the Seller has performed the service in full with express consent on the part of the Consumer who had been informed – before the service was commenced – that upon completion of the service he shall lose the right to withdraw from agreement; for an agreement the price or remuneration for which depends on fluctuations on the financial market that are beyond control of the Seller and that may occur before the lapse of the time allowed for withdrawal from the agreement; for an agreement where the subject of the service are non-prefabricated Goods manufactured as per the specifications of the Consumer or serving to satisfy his unique needs; for an agreement where the subject of the service are Goods which deteriorate quickly or have a short shelf life; for an agreement where the subject of the service are Goods delivered in a sealed packaging that cannot be returned if opened, due to health protection issues or for sanitary reasons, if the packaging is opened after delivery; for an agreement where the subject of the service are Goods which after delivery, due to their nature, remain inseparably connected with other items; for an agreement where the subject of the service are alcoholic beverages, the price of which was agreed on conclusion of the Sales Agreement, and which may be delivered only after 30 days, and the value of which depends on fluctuations on the market that are beyond control of the Seller; for an agreement where the Consumer expressly requested the Seller to visit him in order to perform an urgent repair or maintenance; if the Seller additionally performs other services than those requested by the Consumer, or if he delivers other Goods than the spare parts necessary for the repair or maintenance, the Consumer shall have the right to withdraw from agreement as regards the additional services or Goods; for an agreement where the subject of the service are audio or video recordings or computer software delivered in a sealed packaging, if the packaging is opened after delivery; the delivery of journals, periodicals or magazines, except for a subscription agreement; for an agreement concluded in a public auction; for an agreement for rendering services in the scope of accommodation, other than for residential purposes, transport of items, car rental, catering, services connected with leisure, entertainment, sports or cultural events, if the agreement indicates the day or period when the service is to be rendered; for an agreement for the delivery of digital content which is not recorded on a material carrier, if the performance of the service commences upon an express consent of the Consumer before the lapse of the time for withdrawal from agreement and after he has been informed by the Seller about losing the right to withdraw from the agreement.
6.1.6 In the case of withdrawal from a distance Agreement, such an Agreement shall be deemed not concluded. What the parties have rendered shall be returned in an unchanged condition, unless the change was necessary within the scope of the ordinary management, in particular to determine the nature, features and functioning of the item. The items should be returned immediately, not later than within 14 days. The purchased Goods should be returned to the address of the Seller.
6.1.7 The Seller shall immediately, but not later than within 14 days from receipt of the Consumer’s declaration on withdrawal from the Agreement, return to the Consumer all the payments he has made, including the costs of delivery for the Goods. The Seller shall refund the payment with the same method of payment as was used by the Consumer, unless the Consumer agrees to another way of refund, whereas such a refund shall not generate any cost for the Consumer. The Seller may withhold the refund of payment received from the Consumer until he receives the returned item or the Consumer provides a proof of its return dispatch, whichever comes first, unless the Seller offered to pick up the item from the Consumer by himself.
6.1.8 If the form of delivery of the Goods selected by the Consumer is other than the least expensive, regular form of delivery offered by the Seller, the Seller shall not be obliged to refund to the Consumer any additional costs he has incurred.
6.1.9 The Customer shall only incur the direct cost of return of the Goods, unless the Seller has agreed to incur that cost.
6.2 Complaints for the Goods under warranty
6.2.1 All Goods purchased from kotee.shop come with 12 months manufacturer warranty.
6.2.2 Warranty covers the defects that are effect of material defects or production process. It does not cover any mechanical damage such as: cuts, rips etc, nor damage arising from usage in the way other than the product is intended to. This is laid down in Article 556 – 576 of the Civil Code.
6.2.3 Complaints arising out of a breach of the Customer’s rights guaranteed by law or under these Terms and Conditions should be sent to the following address kotee.shop, Bartosz Kaluzny, os. 6.2.4 In order for the complaint to be processed, the Customer should send or deliver the Goods in question, attaching the proof of purchase, if possible. The Goods should be delivered or sent to the above mentioned address.
6.2.5 The Seller undertakes to process each complaint within 14 days.
6.2.6 If there are any deficiencies in the complaint, the Seller shall request the Customer to supplement it as necessary, immediately, but not later than within 7 days from the date when the Customer received the request.


7.1 What information we collect?
7.1.1 This privacy policy has been compiled to better serve those who are concerned with how their personal information is being used online. By Personal Information we understand all information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. Please read our privacy policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personally Identifiable Information in accordance with our website.
7.1.2 We always try to protect your personal privacy and this privacy statement is here to help you understand what we may do with any information you tell us about. You can access our website home page and browse our site without disclosing your personal data, but if you do give us your personal details, you are accepting these terms. Should you not not agree with this privacy policy, do not give us your details. This privacy policy is part of our Terms and Conditions. If you do give us your details and then decide you do not want us to use your details anymore, please send us an email to customer@kotee.shop. You will have to register to our site if you want to buy for us. It involves you giving us the following personal information: your name and address (including option to save different delivery addresses); contact phone number and e–mail addresses.
7.1.3 Registration enables you to speed up the ordering process, however, you do not have to register with us until you choose to order.
7.2 How do we use your information?
7.2.1 We may use the information we collect from you when you register, make a purchase, sign up for our newsletter, respond to a survey or marketing communication, surf the website, or use certain other site features to do the following: to personalise your experience and to allow us to deliver the type of content and product offerings in which you are most interested; to improve our website in order to better serve you; to allow us to better service you in responding to your customer service requests; to quickly process your transactions; to send periodic emails regarding your order or other products and services; we may also use your information to manage your purchases such as sending a confirmatory email, and your card payments for goods you buy from us and also to deliver the goods to you, we might give your details to our carrier if they deliver on our behalf.
7.2.2 We never sell or pass your information to other parties to send you their offers.
7.2.3 You can always e–mail us with your details and mailing preferences or to check what information about you we are holding.
7.3 Payment. We do not process your payment, and do not hold any information about your cards. All payments are being handled by PCI compliant gateway (see Payment section of this document)

8.2 By placing the order Customer accepts this Terms and Conditions
8.3 The matters not provided for in these Terms and Conditions shall be governed by Polish law.
8.4 kotee.shop is reserving the right to effect amendments to this Terms and Conditions. Amendments to the Rules are applying from the moment of publishing them at kotee.shop
8.5 The presence of product information on the website is not always representing the availability of this products in the warehouse and the possibility of the completion of an order.
8.6 Differences in the appearance of a purchased products, between the visualisation of the Goods in kotee.shop and on the Customers computer resulting from individual computer settings (colour, proportion, etc..) cannot be a base of the customer complaint.
8.7 kotee.shop is making every effort to deliver the highest level of service, however the website can be temporarily out of order, due to website conservation or modernisation.
8.8 All products and names on the kotee.shpo are being used to identification purposes and can be protected and reserved by the act industrial property law (D. U. Nr of 119 of 2003 yr pos. 1117). Proprietary copyrights to all graphic elements, kotee.shop logo, as well as the Goods arrangement and the composition of these elements (so-called layout) of the kotee.shop is entitled to Bartosz Kaluzny. Any usage of the elements mentioned above without a permission is forbidden.
